This document discloses the privacy practices for www.chanelleavila.com (“the Site”), a website owned and operated by Chanelle Avila LLC.  As part of the normal operation of the Site’s services, I collect and, in some cases, disclose information about you.

MINORS

PERSONAL DATA

I collect information so that I can make our products and services better tailored to the people who visit my site and do business with me. I collect this information to (i) deliver products and services you have purchased from me, (ii) to notify you about my product or service offerings that you may be interested in, so long as you have given me consent to do so, and (iii) to keep track of visitor information to my site and/or for advertising purposes.

Personal data means any information capable of identifying an individual. It does not include anonymized data.

I may process the following categories of personal data about you:

(a) Communication Data that includes any communication that you send to me whether that be through the contact form on the Site, through email, text, social media messaging, social media posting or any other communication that you send me. I process this data for the purposes of communicating with you, for record keeping and for the establishment, pursuance, or defense of legal claims.

Visiting www.chanelleavila.com or sending emails to chanelle@chanelleavila.com constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that I provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

I may also use your phone number and email via text or call to make offers about products and programs.

(b) Customer Data that includes data relating to any purchases of goods and/or services such as your name, title, billing address, delivery address email address, phone number, contact details, purchase details and your card details. I process this data to supply the goods and/or services you have purchased and to keep records of such transactions.

(c) User Data that includes data about how you use the Site and any online services together with any data that you post for publication on the Site or through other online services. I process this data to operate the Site and ensure relevant content is provided to you, to ensure the security of the Site, to maintain back- ups of the Site and/or databases and to enable publication and administration of the Site, other online services and business.

(d) Technical Data that includes data about your use of the Site and online services such as your IP address, your login data, details about your browser, length of visit to pages on the Site, page views and navigation paths, details about the number of times you use the Site, time zone settings and other technology on the devices you use to access the Site. The source of this data is from the Site analytics tracking system. I may process this data to analyze your use of the Site and other online services, to administer and protect the business and the Site to deliver relevant website content and advertisements to you and to understand the effectiveness of our advertising.

(e) Marketing Data that includes data about your preferences in receiving marketing from me and third parties and your communication preferences. I process this data to enable you to partake in my promotions such as special offers and discounts, prize draws and free giveaways, to deliver relevant website content and advertisements to you and measure or understand the effectiveness of this advertising.

(f) I may use Customer Data, User Data, Technical Data and Marketing Data to deliver relevant website content and advertisements to you (including Facebook, LinkedIn, or Instagram adverts or other display advertisements) and to measure or understand the effectiveness of the advertising I serve you.

SENSITIVE DATA

As a Christian-based coaching service, I may collect limited Sensitive Data about you, mainly regarding your religious affiliation and practices to better serve you and meet your needs in accordance with your specific beliefs. All Sensitive Data regarding religion is provided voluntarily and is used solely to assist clients and never to use as harm or bias against client. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data.

PERSONAL DATA COLLECTION

I may collect data about you by you providing the data directly to me (for example by filling in forms on the Site or by sending me emails). I may automatically collect certain data from you as you use the Site by using cookies and similar technologies. Please see the cookie policy below for more details about this.

I may receive data from third parties (based in the United States, United Kingdom, in the EU, and based in other countries around the world) such as analytics providers such as Google, advertising networks such as Facebook, such as search information providers such as Google, providers of technical, payment and delivery services, such as data brokers or aggregators.

I may also receive data from publicly available sources including sources based in the United States and sources based in throughout the world.

OPT-OUT OR UPDATING YOUR DATA

You can ask me or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by emailing me at chanelle@chanelleavila.com at any time.

If you opt out of receiving marketing communications this opt-out does not apply to personal data provided because of other transactions, such as purchases, warranty registrations etc.

It is very important that the information I hold about you is accurate and up to date. Please let me know if at any time your personal information changes by emailing me at chanelle@chanelleavila.com OR clicking on the update your information links on any marketing message sent to you.

USE OF YOUR INFORMATION

(a) Promotional Use. I may use personal information about you to enhance my marketing and promotional efforts, and to improve my content and services. I may also use your information to deliver to you advertisements, new services and promotions, and other information to you that is targeted to your interests. You will have the ability to not receive such advertisements, promotions, notices and information by contacting me and requesting to no longer receive such notices, or by clicking “unsubscribe” on any email.

(b) Administrative Notices. I may use your e-mail address and phone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of the Site.  You will have the ability to not receive such advertisements, promotions, notices and information by contacting us and requesting to no longer receive such notices.

(c) Dispute Resolution. I may use information in the file I maintain about you, and other information I obtain from your current and past activities on the Site, to resolve disputes, troubleshoot problems and enforce our Terms and Condition Agreement.

DISCLOSURE TO THIRD PARTIES

I do not sell or rent any personally identifiable information about you to any third party.  I use practices that are consistent with standards in my industry to protect your privacy.  I cannot, however, promise that your personally identifiable information or private communications will remain private.  For example, third parties may unlawfully intercept or access transmissions or private communications on the Site. By accepting this agreement, you waive all rights and agree to hold me harmless from any claims resulting from any action taken by me during or because of any investigations and/or from any actions taken as a consequence of any investigation by either me or law enforcement authorities.

(b) Advertisers. I may disclose aggregate information about my users to advertisers and for other marketing and promotional purposes.  However, I do not disclose any personally identifying information to any of these entities.

(c) Third-Party Suppliers. I may use third party suppliers to assist me in providing the services available on an outside website. I impose contractual restrictions on the use by my third party suppliers of information concerning you, and I do not permit third party suppliers to sell your information to other third parties.

(d) Professional Advisers. I may share your personal data with professional advisers including lawyers, bankers, auditors and insurers.

(e) Service Providers. I may share your personal data with outside service providers who provide IT and system administration services, or general administrative services, or specialized services to support my business or customers.

(f) No Spam. The Site does not tolerate spam.  Therefore, without limiting the foregoing, you are not licensed to add The Site or Chanelle Avila, or Chanelle Avila LLC, including its agents and employees, to your mail list (e-mail or physical mail) without their express consent after adequate disclosure.

I require all third parties to whom I transfer your data to respect the security of your personal data and to treat it in accordance with the law. I only allow such third parties to process your personal data for specified purposes and in accordance with my instructions.

DISCLOSURES YOU MAKE TO THIRD PARTIES

The Site does not control the privacy policies of third parties. When you disclose information to third parties on the Site (or any other website) about yourself, you are subject to the privacy customs and policies of that third party.  It is your responsibility to find out about the privacy policy of any such third parties.

This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. I do not control these third-party websites and are not responsible for their privacy statements. When you leave my website, I encourage you to read the privacy notice of every website you visit.

DATA SECURITY

I work with third parties that have industry standard security measures to prevent your personal data from being accidentally lost, used, altered, disclosed, or accessed without authorization. I also allow access to your personal data only to those employees and partners who have a business need to know such data. They will only process your personal data on my instructions, and they must keep it confidential.

DATA RETENTION

I will only retain your personal data for as long as necessary to fulfill the purposes I collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for, I look at its amount, nature and sensitivity, potential risk of harm from unauthorized use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

In some circumstances I may anonymize your personal data for research or statistical purposes in which case I may use this information indefinitely without further notice to you.

Under data protection laws you have rights in relation to your personal data that include the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data and (where the lawful ground of processing is consent) to withdraw consent.

I may need to request specific information from you to help me confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. I may also contact you to ask you for further information in relation to your request to speed up my response.

I try to respond to all legitimate requests within one month. Occasionally it may take me longer than a month if your request is particularly complex or you have made several requests. In this case, I will notify you.

COOKIES
